Insurance
Bad Faith
Have
you noticed how efficient an insurance company
can be when seeking payment of a premium from
you as compared with paying your claim? This is
no accident. It occurs by design. In legal terminology,
this sort of behavior is referred to as "insurance
bad faith" or breach of the covenant of good
faith and fair dealing.
Whether
the claim involves medical bills, homeowner
coverage, a business loss, or an uninsured/
underinsured motorist policy, insurance companies
routinely allege that they somehow lost or
did not receive supporting documents sent
by you. The insurance adjuster assigned to
your claim, who seems to change weekly, engages
in endless foot-dragging while "investigating"
or "evaluating" the matter. If you're
fortunate, you eventually get a low-ball settlement
offer amounting to far less than the value
of your claim. |
The average policyholder wonders how much misery
he or she is obligated to endure in dealing with
the insurance company. The answer is, "none".
You paid your premiums year after year, and for
what? For that day when it is necessary to make
a claim. But the insurance company fosters the
impression that it is doing you a favor by responding
to your claim. Well, just keep in mind that you
paid in full for all the coverage due under your
policy. Until such is provided to you, your insurance
company has done nothing whatsoever to earn all
those premiums you faithfully paid over the years.
The
Traut Firm
has successfully prosecuted hundreds of such insurance
bad faith cases. All cases are handled on a contingency
basis: No fee is paid unless and until you win.
And there are no "up front" costs to
you. Unlike many firms which will routinely assign
your case to an associate attorney (who gains
experience at your expense), at the Traut
Firm you get either James or Eric
to personally represent you. James was voted the
2002 Trial Lawyer of the Year by the Orange County
Trial Lawyers Association. Eric received the same
honor for 2003. So, if you are interested in receiving
the insurance coverage you paid for, while inflicting
some well-deserved grief on that reprehensible
insurance company, you can do no better than the
Traut Firm.
